Terms of Service

Effective Date: 18 March 2026

Issued by Glass Hammer Ltd, a company incorporated in England and Wales (Company No. 14672595), with registered address at Watford, WD17 3DP ("Glass Hammer", "we", "us", or "our").

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Zumbook platform ("Platform"), including any associated websites, software, tools, and services operated by Glass Hammer Ltd.

By registering for an account or by continuing to use the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.

These Terms apply to all users of the Platform, including fitness instructors, class organisers, and any individual or business that accesses the Platform in any capacity ("Instructor" or "you").

2. Definitions

In these Terms, the following words have the meanings given below:

  • "Account" means the account you register with us to access the Platform.
  • "Booking" means a reservation made by a Customer for a class, event, course, or camp listed by an Instructor on the Platform.
  • "Customer" means any individual who makes a Booking through an Instructor's Zumbook-powered page.
  • "Glass Hammer" means Glass Hammer Ltd (Company No. 14672595), the operator of the Platform.
  • "Instructor" means any person or entity that registers for an Account to manage and promote fitness-related activities using the Platform.
  • "Listing" means a class, event, course, or camp posted by an Instructor on the Platform.
  • "Platform" means the Zumbook software-as-a-service platform, including all associated websites, subdomains, tools, and services provided by Glass Hammer.
  • "Subscription" means the paid plan under which an Instructor accesses the Platform.
  • "Subscription Fee" means the recurring fee payable by the Instructor in exchange for access to the Platform.

3. Eligibility

  1. You must be at least 16 years of age to register for an Account and use the Platform.
  2. By creating an Account, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained consent from a parent or legal guardian.
  3. The Platform is available to users in all jurisdictions. It is your responsibility to ensure that your use of the Platform complies with all applicable laws in your jurisdiction.
  4. There are no restrictions on the type of fitness activity for which you may create Listings, provided that all activity complies with these Terms and applicable law.

4. Accounts and Registration

  1. To use the Platform, you must create an Account by providing accurate, current, and complete information as prompted during the registration process.
  2. You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.
  3. You must notify us immediately at the contact details set out in these Terms if you suspect any unauthorised use of your Account.
  4. Glass Hammer may assist you during the onboarding process, but you remain solely responsible for your Account and all activity conducted through it.
  5. You may not create an Account on behalf of another person without their express authorisation.
  6. Glass Hammer reserves the right to refuse registration, suspend, or terminate any Account at its discretion, including (without limitation) where it suspects fraudulent activity, misuse, or breach of these Terms.

5. Subscriptions, Fees, and Billing

5.1 Subscription Plans

  1. The Platform is offered on a subscription basis. Details of available Subscription plans and pricing are set out on the Zumbook homepage and are subject to change from time to time.
  2. Promotional offers, trials, and discounts may be made available at Glass Hammer's discretion and are subject to the specific terms communicated at the time of the offer.

5.2 Billing Cycles

  1. Subscriptions are available on a monthly or annual basis, as selected at the time of purchase.
  2. Subscription Fees are payable in advance. Your Subscription will automatically renew at the end of each billing period unless cancelled in accordance with clause 11.

5.3 Price Changes

  1. Glass Hammer reserves the right to change Subscription Fees and the content of Subscription plans at any time at the manager's discretion.
  2. We will provide you with at least 45 days' written notice of any price increase before it takes effect. Continued use of the Platform after the new pricing takes effect constitutes your acceptance of the revised fees.

5.4 Non-Payment and Suspension

  1. If a Subscription Fee is not paid when due, Glass Hammer reserves the right to restrict your Account.
  2. If payment remains outstanding for 10 days following the due date, your ability to accept new Bookings will be suspended until the outstanding amount is paid in full.
  3. Glass Hammer reserves the right to terminate your Account if payment remains outstanding for a prolonged period, with reasonable written notice where practicable.

5.5 Refunds

  1. All Subscription Fees are non-refundable, except as required by applicable law. No refunds or credits will be issued for partial subscription periods, unused features, or early cancellation.

6. Instructor Payments and Stripe Connect

  1. Glass Hammer is not the merchant of record for Bookings. Each Instructor is solely responsible for collecting payment from their Customers and is the merchant of record for all transactions arising from their Listings.
  2. Payment processing for Bookings is facilitated through Stripe Connect. By using the payment functionality of the Platform, you agree to Stripe's terms of service and connected account agreement, as updated from time to time by Stripe.
  3. Instructors are paid directly by Customers through the payment infrastructure. Glass Hammer does not hold, pool, or settle funds on behalf of Instructors.
  4. Instructors are solely responsible for all financial and tax obligations arising from payments received from Customers, including VAT, income tax, and any other applicable taxes or levies.
  5. Glass Hammer accepts no liability for any payment disputes, chargebacks, or failed transactions between Instructors and their Customers. Any such disputes are the sole responsibility of the Instructor as merchant of record.
  6. Instructors must ensure their Stripe account remains active and in good standing. Glass Hammer is not liable for delays or failures in payment processing caused by Stripe or any third party.

7. Instructor Content and Intellectual Property

7.1 Ownership

  1. You retain full ownership of all content you upload, create, or publish on the Platform, including class descriptions, images, videos, branding, and other materials ("Instructor Content").
  2. By submitting Instructor Content to the Platform, you grant Glass Hammer a non-exclusive, worldwide, royalty-free licence to host, display, and reproduce that content solely for the purpose of operating and improving the Platform.

7.2 Glass Hammer Intellectual Property

  1. All intellectual property rights in the Platform, including its software, design, functionality, and branding, are owned by Glass Hammer or its licensors.
  2. You are granted a limited, non-exclusive, non-transferable licence to use the Platform in accordance with these Terms. No other rights are granted.
  3. You must not reverse-engineer, decompile, disassemble, scrape, or otherwise attempt to derive the source code or underlying architecture of the Platform.
  4. You must not use any automated means (including bots, scrapers, or crawlers) to access or extract data from the Platform without our prior written consent.

7.3 Branding and Attribution

  1. Your Zumbook-powered instructor website will display a link back to Zumbook as part of the Platform's standard functionality.

8. Acceptable Use

  1. You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use of the Platform.
  2. Without limiting the foregoing, you must not use the Platform to:
    • create Listings that are misleading, false, or fraudulent;
    • publish, distribute, or facilitate access to sexually explicit, pornographic, or obscene content;
    • operate or promote gambling, wagering, or any activity that requires a gambling licence;
    • engage in, promote, or facilitate any illegal activity;
    • send spam, unsolicited communications, or engage in phishing;
    • upload or transmit viruses, malware, or other malicious code;
    • harass, abuse, defame, or threaten any individual;
    • impersonate any person or entity, or misrepresent your identity or affiliation;
    • violate the privacy or data protection rights of any individual;
    • circumvent, disable, or interfere with security features of the Platform;
    • use the Platform to facilitate or promote discrimination on any protected ground.
  3. Glass Hammer reserves the right to remove any content, suspend any Listing, or terminate any Account that it reasonably believes is in breach of this clause or any applicable law, without prior notice.

9. Data Protection and Privacy

  1. Glass Hammer processes personal data relating to Instructors as a data controller. The basis for such processing and your rights in relation to your personal data are set out in our Privacy Policy, which forms part of these Terms.
  2. With respect to personal data relating to your Customers, you are the data controller and Glass Hammer acts as your data processor. By using the Platform, you enter into a data processing agreement with Glass Hammer on the terms set out in our Privacy Policy.
  3. You are responsible for ensuring that you have a lawful basis to collect and process your Customers' personal data, and for providing your Customers with appropriate privacy notices in compliance with applicable data protection law, including the UK GDPR and the Data Protection Act 2018.
  4. You must not use the Platform to collect, store, or process personal data in a manner that is unlawful, excessive, or incompatible with the purposes for which it was collected.
  5. You agree to notify Glass Hammer promptly if you become aware of any actual or suspected personal data breach that affects data processed through the Platform.

10. Liability and Indemnification

10.1 Glass Hammer's Liability

  1. To the fullest extent permitted by applicable law, Glass Hammer's total aggregate liability to you for any loss or damage arising out of or in connection with these Terms or your use of the Platform shall not exceed the total Subscription Fees paid by you to Glass Hammer in the three-month period immediately preceding the event giving rise to the claim.
  2. Glass Hammer shall not be liable for any indirect, consequential, special, incidental, or punitive damages, including loss of profit, loss of data, loss of business, or loss of goodwill, even if Glass Hammer has been advised of the possibility of such damages.
  3. Glass Hammer does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. We do not guarantee that the Platform will meet your specific requirements.

10.2 Instructor-Customer Disputes

  1. Glass Hammer is not a party to any agreement between an Instructor and their Customers. We accept no responsibility or liability for any dispute, claim, or issue arising between an Instructor and a Customer, including in relation to class cancellations, injuries, refunds, or the quality of services provided.
  2. Instructors are solely responsible for ensuring that their activities are conducted safely and in compliance with all applicable laws, regulations, and professional standards, including any requirements relating to insurance, qualifications, and venue safety.

10.3 Instructor Indemnification

  1. You agree to indemnify, defend, and hold harmless Glass Hammer, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
    • your use of the Platform in breach of these Terms;
    • your Listings, Instructor Content, or the services you provide to Customers;
    • any injury, loss, or damage suffered by a Customer arising from your classes, events, courses, or camps;
    • any claim that your Instructor Content infringes the intellectual property rights of a third party;
    • your failure to comply with applicable data protection, tax, or consumer law.

11. Term and Termination

11.1 Duration

  1. These Terms commence when you create an Account and continue until terminated by either party in accordance with this clause.

11.2 Termination by You

  1. You may cancel your Subscription and terminate your Account at any time by providing 30 days' written notice to Glass Hammer. Notice must be given through the Account settings or by contacting us at the address set out in clause 14.
  2. Following cancellation, you will retain access to the Platform until the end of your current billing period. No refund will be issued for the remaining period.

11.3 Termination by Glass Hammer

  1. Glass Hammer may terminate your Account or suspend your access to the Platform by providing 30 days' written notice for any reason.
  2. Glass Hammer may terminate your Account immediately and without notice in the event of:
    • a material or serious breach of these Terms that is not capable of remedy, or that you have failed to remedy within 14 days of receiving written notice;
    • fraudulent activity, dishonesty, or wilful misconduct;
    • conduct that poses a risk to the safety, security, or reputation of the Platform or its users;
    • non-payment of Subscription Fees for a period exceeding 30 days after suspension under clause 5.4.

11.4 Effect of Termination

  1. On termination of your Account for any reason, your right to access the Platform will cease.
  2. You may export your data (including class information, booking history, and Customer data) at any time while your Account is active. We will not be obliged to retain your data following the termination of your Account.
  3. Clauses that by their nature are intended to survive termination (including clauses 7, 9, 10, and 13) shall continue in force after termination.

12. Changes to the Platform and These Terms

  1. Glass Hammer reserves the right to modify, update, or discontinue any aspect of the Platform at any time, with or without notice, provided that we will endeavour to give reasonable advance notice of material changes that may affect your use of the Platform.
  2. Glass Hammer reserves the right to amend these Terms at any time. We will notify you of material changes by email or by posting a notice on the Platform. Your continued use of the Platform following the effective date of any changes constitutes your acceptance of the revised Terms.
  3. If you do not agree to any revised Terms, you must stop using the Platform and cancel your Subscription in accordance with clause 11.

13. Governing Law and Dispute Resolution

  1. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.
  2. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.
  3. Before commencing any legal proceedings, both parties agree to attempt to resolve any dispute by good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days of written notice of the dispute, either party may refer the matter to mediation under the Centre for Effective Dispute Resolution (CEDR) Model Mediation Procedure. If mediation fails or is not agreed within a further 30 days, either party may proceed to litigation.

14. General Provisions

  1. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Glass Hammer in relation to the Platform and supersede all prior agreements, representations, or understandings.
  2. If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
  3. Glass Hammer's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  4. You may not assign or transfer your rights or obligations under these Terms without Glass Hammer's prior written consent. Glass Hammer may assign these Terms in connection with a merger, acquisition, or sale of assets.
  5. Nothing in these Terms shall create or be deemed to create a partnership, agency, or employment relationship between you and Glass Hammer.
  6. Any notice required or permitted under these Terms shall be given in writing. Notices to Glass Hammer should be sent to: Glass Hammer Ltd, Garden Close, Watford, WD17 3DP, or by email to [email protected]. Notices to you will be sent to the email address associated with your Account.
